On Sunday, May 31, 2020, Atoka Police Officer Chase Franklin was on patrol when he observed a black 2013 Dodge Ram 1500 pickup, traveling on North California Avenue, with a defective brake light.
Officer Franklin made contact with the driver, Jayson Lee Lopez, 27, of Atoka. Lopez had an odor of alcohol coming from his person, and had red watery bloodshot eyes.
After being asked where he was coming from, Lopez replied the Crow’s Nest located in Lane. The officer asked him how much he had to drink. “Too much,” stated Lopez. “Probably too much to be driving.”
Officer Franklin asked Lopez to exit the vehicle and participate in a Standardized Field Sobriety Test (SFST). When asked to stand on one foot Lopez lost his balance and nearly fell. The test was stopped for safety.
Lopez was transported to the Atoka County Jail and given the State’s breath test. His results were 0.12, legally intoxicated in Oklahoma is 0.08.
He is charged with driving a motor vehicle while under the influence of alcohol (misdemeanor).
