Caney Police Officer John Anderson was working a stationary patrol on Highway 69 and Voca Road on Tuesday, August 18, 2020.
Officer Anderson observed an orange Dodge pass his unit at a high rate of speed. Radar confirmed the vehicle to be traveling 80 miles per hour in a 60 mile per hour work zone.
The driver of the vehicle, Isaac C. Nuncio, 24, of Houston, Texas, admitted to having a “few” to drink with lunch.
Officer Anderson inquired as to how many was a few. Nuncio said, “like three.”
Oklahoma Highway Patrol Trooper Miller arrived on scene to conduct a Standardized Field Sobriety Test.
Nuncio submitted a Preliminary Breath Test of 0.075 breath alcohol content. Legally intoxicated in Oklahoma is 0.08. He advised the officers there were no open containers in his vehicle.
After giving permission for his vehicle to be searched an opened Jim Bean bottle, marijuana, and a loaded 9mm firearm were located.
Officer Anderson placed Nuncio under arrest and asked if he would submit to the State’s blood test. Nuncio agreed to the State’s test and was transported to the Atoka County Medical Center before being booked at the Atoka County Jail.
Nuncio is charged with driving a motor vehicle while under the influence of alcohol (misdemeanor), possession of controlled dangerous substance (misdemeanor), and carrying a firearm while under the influence (misdemeanor).
