On Monday, October 5, 2020, Atoka Police Officer Cody Poe was working stationary radar on Highway 69 near Shady Lane. The officer observed a maroon 2018 KIA Optima traveling 76 miles per hour in a 55 mile per hour zone.
Officer Poe made contact with the driver, identified as Ernst Simon, 21, from Miami, Florida.
Simon explained to the officer that he was trying to pass a vehicle. Officer Poe advised him that traveling 21 miles per hour over the speed limit to pass another vehicle was not a valid reason for speeding.
During the conversation, the officer observed the odor of marijuana coming from inside the vehicle.
Simon stated his license was suspended in Florida for unpaid tickets. He told the officer that he had smoked marijuana, but there was none in the car.
Officer Poe conducted a search of the vehicle, locating marijuana shake and a burnt marijuana cigarette.
Simon was placed under arrest and transported to the Atoka County Jail for no valid driver’s license, speeding, and possession of drug paraphernalia.
