On Monday, November 30, 2020, Atoka Police Officer Jedediah Griffith, was on routine patrol when he observed a black 2004 Ford Taurus, traveling east on West Seventh Street, with neither driver or passenger wearing a seat belt.
The vehicle came to a stop near the intersection of West Seventh Street and South California Avenue as Officer Griffith conducted a traffic stop.
The Officer made contact with the driver and the passenger, identified as Catlin Joe Provence, 30, of Atoka, and advised them of the reason for the stop.
As both parties were retrieving their identification, Officer Griffith noticed the odor of marijuana coming from the vehicle. Both occupants were asked if there was any marijuana in the vehicle.
They responded, “No, you can search the vehicle if you would like.”
The officer returned to his patrol unit to check for warrants and for valid identification. Dispatch advised Officer Griffith that both individuals were clear of warrants, and that the driver had a valid driver’s license out of Kansas.
Provence was asked to exit the Taurus for a pat search. His left front pocket had a ziplock baggie hanging out. He advised the officer it was “dab.”
Officer Griffith retrieved the baggie from Provence’s pocket, and observed a tan sticky substance weighing less than one gram. The substance that later field tested positive for marijuana. Provence said he did not have a medical marijuana license.
He was placed under arrest for failure of passenger to wear seat belt, possession of marijuana, and possession of drug paraphernalia.
The driver was cited for her violations and released from the scene. Provence was transported to the Atoka County Jail for booking.
