Driver's License Checkpoint Leads to DUI-Marijuana Arrest

A driver's license and safety checkpoint on East Court and 10th Street late Sunday night resulted in the arrest of a man for driving under the influence of marijuana.

According to a police report, officers were conducting the checkpoint around 9:15 PM when a blue Infiniti QX60 approached. Atoka Police Sgt. Cody Poe made contact with the driver, identified as Jayson Shanks. While Sgt. Poe was checking Shanks' license, another officer approached the driver's window and detected an odor commonly associated with marijuana.

When asked, Shanks provided a medical marijuana card and admitted to having marijuana in a brown paper sack on the front passenger seat. The officer noted that Shanks' eyes appeared glossy and his pupils were dilated.

Shanks stated he had last consumed marijuana approximately two hours prior. He was asked to pull over and exit his vehicle to undergo field sobriety tests, to which he agreed.

During field sobriety tests, Shanks reportedly showed multiple signs of impairment, including issues with eye tracking, balance, and coordination. Specifically, officers noted indicators such as eyelid tremors, an inaccurate sense of time, and several clues on the walkand- turn and one-leg stand tests. Shanks also reportedly struggled with the finger-tonose test.

Based on these observations and the results of the field sobriety tests, Shanks was placed under arrest for driving under the influence. After being read the Oklahoma State Implied Consent Test Request, he agreed to a blood draw.

Shanks was transported to the Atoka County EMS Station for the blood draw and subsequently taken to the Atoka County Jail for booking without further incident.
